Prosecuted for what? Are we supposed to wait until they fully explain to us why they broke into our homes?

BOOM! Yer dead, sucker. His family can seek his intentions through an Ouija Board.

Default home owner shoots and kills home burglar should he be prosecuted?

Are you serious?

Of course not!

Robbery and burglary are dangerous professions. Gunshot wounds are an occupational hazard.

Let me offer a simple analogy:

If someone walks around the desert, sticking his hand into every hole in the ground, is it the snake's fault when he gets bitten?

I think he should go to trial for it. He did kill someone which is against the law, so is firing a gun in a city (if he is in the city limits)

Though he shouldn't be found guilty. Is it a waste of time to do this? Yes, but it's to make the law equal for everyone or no one will follow them. He shouldn't have a "waiver" to shoot someone in any situation without facing consequences of it

Being a criminal is a risky occupation. Eventually you're going to run across an intended victim that will defend himself and his property rather than cower in fear, it's only a matter of time. Hopefully most criminals will run across this person sooner rather than later.

I presume that there are details left out. Most people don't just pop off other people unless there is a reason. On the other hand, it's pretty well accepted that breaking into a house in Arizona is a risky endeavor, and most people in Arizona don't say things like "the homeowner should have been prosecuted for shooting a burglar", So it seems like there might be additional circumstances that haven't been included. That makes me question the situation. It's hard to assess hearsay. Did the homeowner run down the street after the retreating burglar and shoot the burglar in the back or something?

If castle doctrine applies neither of those are prosecutable.

Anyone who says an individual who legally possesses a firearm should be prosecuted for shooting someone who breaks into their home is an idiot.

Someone broke into your home, they may be unarmed or armed, but you don't know that. You don't know what harm they are trying to cause on you or your family.

What if you have kids too? Should you just tell everyone to sit down, be quiet, and let the intruder have his way?

Self-righteous morons.

Give me a break.

According to Monday Morning Quarterbacks like you, an innocent person who awakes to find an intruder in his own home is supposed to inquire as to his intentions. Thankfully, saner minds prevailed.

BTW, if anyone ever dares to break into our home, where he doesn't belong, and thinks that DH or I won't protect ourselves, it'll be the second mistake he made that day.

As a woman who is home alone often, I have 3 loaded guns at different points in the house. I am not going to wait and ask questions as to why the intruder is in the house or what their intentions are. I will protect myself and my child first, worry about the criminals reasoning later.

As a home-owner who has had their home burglarized (thankfully I wasn't home at the time), I can honestly say that anyone who has their home broken into is justified in doing anything they need to in order to protect themselves (and their family, if their family is also home).

I think it's great when a burglar is taken out of commission after they try to break into someone's home. This means that the next would-be burglar will think twice about doing so. IMHO it's a deterrent for possible future crimes. I wish more states had the "castle doctrine/law", if that's what the law is - IIRC, this law states that you can defend yourself if someone breaks into your home.

Those bleeding hearts who say the homeowner should get in trouble for this obviously have never had their own homes broken into. This attitude is exactly why so many criminals are coddled in our society, and get away with doing whatever they want. If you break into someone's house you don't have any rights.

It makes me sick to read stories of homeowners who get in trouble for defending themselves after someone breaks into their house. To me, this is the real crime here...
