I want everyone to be aware of a custody case in Alamance county in front of Judge Lambeth. The mother and father are from Pennsylvania and moved to NC. They were never married and had a child in NC. The father walked out on them when the child was 9 months old so it forced the mother to move back with family in PA. She was awarded primary custody and had it for 5 and a half years. she worked long hours supporting this child and his medical needs because the father would not pay child support or help with medical bills. He was still allowed to see the child regularly. He continuously got away with this and when it was brought to the judges attention he ignored it. This judge would not transfer this case to PA even though the vast majority of witnesses resided there including all doctors, teachers, therapists and professionals. The case went up on appeal however this judge said he still had jurisdiction, even though many lawyers said that was not the case.
This judge believed baseless lies from the father about the mother. The mother was never involved in drugs or criminal charges. She had a very tight bond with her son. This judge went against the childs will and gave primary custody to the father with supervised visitations to the mother. This mother has now went a month and a half without talking to or seeing her son. There are countless people who could testify on the mothers behalf but the judge heard a one sided case without anyone testifying on the mother son relationship.
It is a very sad situation for the child and is so wrong on many levels. This judge would not transfer this case for some suspicious reason. There should not have been an objection as both families are from PA. He switched over custody and never ruled the mother unfit.
We have been told by other attorneys they would nit step back in the Alamance courtroom because of the judges that are there. We are beginning to see why.
