Quick question,

Manage a rental community (smaller side) one of my tenants just moved in (last week). Did not indicate they had a dog on the application, never signed an animal addendum, and never put down a pet deposit. It's a pitbull which we do not allow in the community. Problem is, no one wants to enter the unit to remove this dog, he looks scary, I know he may be harmless but does anyone know of a good company that removes unauthorized animals from dwellings? Humane society will pick up the animal but they wont enter the unit to remove it. Any advice would be greatly appreciated! Thanks!

Why would you enter? I would think you would just serve a notice to the tenant that he is in violation and let him know the dog cannot stay.

That would be the ideal situation but unfortunately, there are many difficult renters out there that do not follow lease regulations. He has already received notice he is in violation, shows no intention of removing the dog. Lease agreement authorizes us to enter and remove the animal, we just would rather a professional remove this animal.

Seems to me you need to review the lease agreement to see what action you can take, legally. If it's not addressed, then you're stuck. Not sure what your recourse would be. Consult a lawyer.

I would make darn sure you have a paper trail where you can prove you have given him a specific deadline for removal.

Here is what the Residential Lease Applications States.

Acknowledgement & Representation:
(1) Signing this application indicates that Applicant has had the opportunity to review Landlord’s tenant
selection criteria, which is available upon request. The tenant selection criteria may include factors
such as criminal history, credit history, current income and rental history.
(2) Applicant understands that providing inaccurate or incomplete information is grounds for rejection of
this application and forfeiture of any application fee and may be grounds to declare Applicant in breach
of any lease the Applicant may sign.
(3) Applicant represents that the statements in this application are true and complete.

If that is all the lease says on this issue then it doesn't give you the right to remove the dog. It would be fairly unusual for a landlord to have the right to enter the premises to remove something of the owners, even more so considering that this is a life animal.

That's not what the lease contract says. Those recitations are from the Application not the contract. Those recitations are what the landlord can use to decline an application and have no relevance to the issue at hand.
