I have been waiting for TWC to set the date for my appeal hearing for unemployment benefits and its been a month since my request for appeal was received by them.

Is there a time limit that they have to abid by for setting appeal dates? How long do I have to wait to get an appeal? This is dragging on and on. I first applied in early Nov. 08 and it took TWC a month & 1/2 just to say I was denied and now I'm waiting to get an appeal date. I'm still looking for work and its getting really tough financially.

I need to find a lawyer who can handle this appeal for me. Anyone know of someone in Houston, TX?

I hope you mean 2009 and not 2008. The appeal process can drag on. You should receive a letter with your date for the appeal hearings that are usually conducted over the phone. Make sure you have sent all of your information to the agency as directed and call to follow up that they have received everything and also check on the hearing date. You can go to the Texas Workforce Commission website and get information on what to expect during an appeal hearing.

Have patience because they work in slow motion. I hope everythging works out ok.

Oops, my bad...yes I meant that I originally filed the claim in Nov. 09.

I sent my appeal request by certified mail with signature receipt. I know they received it by the deadline to file for appeal. I have not received a letter yet with the appeal hearing date but I expected I would not have to wait a month just to receive a letter with the hearing date information. I want to hold off on calling them about the hearing date as I want to talk to a lawyer before I call them.

I need to find a good lawyer in Houston, Harris County, Texas that deals with unemployment compensation appeal hearings. This is very important to me.

Well good luck with everything. I handled everything myself and have a stack of correspondence about 3 inches thick. Save everything including the certified mail receipt. My problem was a simple one. Dates were wrong and they said I had not correctly reported wages I earned that I did NOT earn. As simple as the mistake was, the process was a headache and it seems like it takes forever. I went almost 2 months with nothing from them and after the appeal I had to wait another 2 weeks before I was sent what I was owed.

I'm happy to hear you had a good outcome and that yours resolved after 2 months. I'm at 3 months now with no appeal date in the works.

My case is a bit more complicated because the employer lied and sent TWC a false resume that he claimed was mine. I guess you can term my employment termination as "Constructive Termination." I don't know if TWC knows what this means so this is why I need a lawyer to handle mine. I need someone who knows employment law and especially the TWC unemployment compensation system.
