[SIZE=3]We were supposed to close today. Just received call from my realtor. Seller needs a couple of more days because they have not moved all of their stuff out of the house (wants a lease back). I am not comfortable with this because I have heard horror stories about buyers getting possession of the home after closing and the homes were missing fixtures and some damage. I scheduled a final walk-thru two hours before closing and a locksmith to change the locks immediately after closing.[/SIZE]

If all they need is a few days, delay the closing. The worst situation you could find yourself in is that they sellers refuse to move after you close and you have to evict them which could take money and time. Personally, I would not close until they are out and you have a satisfactory walk through. Just my opinion though.

I've had to lease back twice, $150 a day, and I never trashed the house. I couldn't get the trucks, and both closings all done on the same day. It's really not all that uncommon.


But I think I would personally take it by on a case by case basis.

It's not an ideal situation - I prefer not to do it - but there are times it can't be avoided. Is it because they are closing on another house or is it because they are disorganized? If they are closing on another house, they can't move their stuff there until the second close. Most of the time, it goes OK and they leave the house fine. The only bad seller that left a mess, ironically, was a Realtor.

Ask for a security deposit and let them know if they leave the house good and clean, 100% will be refunded back to them. If not, you will give them an itemized bill of charges and keep the money from the deposit.

I needed a lease back when I purchased my home. I drove down here from Illinois just to sit at the title company all day waiting for Wells Fargo to do their thing. I didn't end up closing until that next Tuesday (the original closing was set for the Friday before). Meanwhile, the movers were set to deliver my belongings that Saturday. We ended up doing a leaseback out of necessity~ all went well. I agree with the poster who said it is a case by case basis.
Should you decide to do so, take pics or better yet a video recording of the home's condition. A security deposit is also a great idea. When all is said and done, go with your gut.

You have probably resolved this by now but I would vote for delay of closing unless there is a really good reason their stuff hasn't been removed. If it is just disorganization, I wouldn't trust them with a lease back.
