Question regarding rural land rights (Madison, Grant: house, construction, live)

I couldn't think of a better way to title this thread, but here's the situation.

My wife and I live on 5 acres in rural northern Madison County. Our home site sits on a small hilltop and gently slopes down from the back of the house to our pond and a creek in the very back corner. Our neighbors behind us have a 40 acre or so place. There is a lot of work going on back there that I am not sure about. Near the one end of our property where the hill is, on their side they have excavated tons and tons of dirt nearly up to our fence line for reuse somewhere else on their property. Granted they haven't touched our property directly, but we're concerned about that cliff they have basically created eroding back into our property line over time. Also whatever they are doing is causing the back corner of our property with the creek to flood over when it rains heavy. What recourse do we have to protect our own property from negative effects of our neighbor's alteration of their own land? I do plan to speak directly with our neighbors about this. But assuming they intend to continue and we are still concerned, who would we contact to assess this potential impact on our land? A government agency? Surveyor?

dee - talking to the neighbor is a good start.

The Alabama Department of Environmental Management is strict about preventing construction erosion into waterways. There's a good chance that they could stop the project until permits and mitigation measures are in place (IIRC depending on whether the creek is protected State waters).
