Hello everyone,

My fiance and I are looking to move to Benewah County and are looking for the best area. We do not need an incorporated town. We are looking for a larger chunck of land ~5 acres to build a house on.

The property we have been looking at is located in the Coeur D'Alene Indian Reservation. We were wondering if there were any issues, or strange laws if we were located in this area?

Any comments, or suggestions are greatly appreciated! Thank you!

It is like any other indian reservation, it has it own rules and bylaws that are different than just being rural. I wouldn't call it a bad thing, its just something you need to have your REALTOR get you the info on. Most of the time, they have to approve you.

Really???

We are looking at a few different areas to buy land and one of them is the exact area that the OP is asking about....our realtor told us that there is absolutely no difference between buying inside or outside that reservation boundaries other than the tribe having hunting rights on any land in the reservation boundaries.....is this not accurate? By "they" I can only assume you mean the tribal council/government?

I have heard that if a non-indian buys acerage on the reservation, that they are not allowed to hunt big game on your own property. And that tribal members are allowed to hunt on your land without your permission. I do not know if this is true, maybe someone can clairify this.

This is something I am very interested in as I currently live in Benewah County and plan to buy land in the future here. I did some research and found an article in the CDA Press that has some information. The hunting of private owned land by tribal members is being disputed. The article is from last year, but I have found no changes on record yet.

That would be a big issue. I would not want someone shooting a rabbit or a deer on my property without my knowledge. The size shouldnt matter. That would be putting other people in danger. Especially if there will be younger children around. Unacceptable. I would love any other information about this if anyone has any!
Thank you!

I would suggest do a quick google search for the Indian Reservation.. The Official Site of the Coeur d'Alene Tribe of Indians there i did it for you..
Go to that site and contact the tribe directly and ask them. That way there is not miscommunication between you and the realtor and the tribe.

I am just speaking from the experience I had recently. My client was 1/10 indian and that may be the difference. But the hunting thing was one of the differences I was referring too.

This has been a very valuable thread for me, as it has me researching before I buy. The hunting anytime on land I personally own, is not something I am willing to tolerate. If I do find different info on this, I will post an update and I hope others will do the same.
