If the old guy is telling the truth the two men swerved and tried to hit him with the truck, that should be grounds to use lethal force. Every state is different but you are able to use lethal force when threatened by two unarmed men, with one unarmed man their is no cause for lethal force. It will be really hard for the DA to prosecute the old man because he can just say he feared for his life. Now if he shot them while they were driving away he is going to spend some time in jail.
If you are going to have a firearm you MUST know when and when you can't use it.

Colorado just charges illegals with "Agricultural trespass" for crimes such as Grand Larceny, DUI, Drugs, Sexual assault, etc..
