McALLEN, Texas (AP) - Mexico's president-elect asked the U.S. Supreme Court on Monday to evaluate the murder case of a Mexican woman who was sentenced to 99 years in prison for the death of a Texas boy.
Enrique Pena Nieto filed a brief in his personal capacity supporting the appeal of Rosa Estela Olvera Jimenez. He argued that Jimenez was denied due process because she wasn't given funds to hire expert witnesses and had ineffective counsel.
It also could also impact other cases. The brief notes that more than two million Mexican nationals live in Texas, and many of them - like Jimenez - are there illegally. Without resources, the brief argues, they are at a disadvantage in the criminal justice system.
This woman was not denied due process. In fact, she received it at U.S. taxpayers' expense. Her inability to afford a high-powered attorney and expert witnesses does not negate due process. She was convicted and sentenced to 99 years, which indicates overwhelming evidence of her guilt. Furthermore, how on earth does a 2-year-old boy have 5 paper towels lodged in his throat if properly supervised? Moreover, how does a child even swallow 5 paper towels, if not forced?
Now, the Mexican government has intervened on her behalf, and dares to whine about other "disadvantaged" Mexican criminals illegally living in Texas. Well, that's just too damn bad. If Mexico is so concerned about their criminal citizens, why don't they keep them in Mexico? Then, when they commit crimes, they'll be tried according to their judicial system, which I doubt offers a top-notch legal defense at taxpayers' expense. When will this insanity end?
See the problem is that the US government keeps on giving, giving, giving to illegals and now the Mexican government is complaining that "she wasn't given funds"???? WTF!!! She's petitioning Mexico, the country she left, to get involved?
American citizens who don't have "funds" have no choice but to use a court appointed attorney (at the taxpayer's expense). So a court appointed attorney isn't good enough for illegals??? Now the government has to dig deeper and provide illegals with high end legal representation and cover the costs for professionals to testify on their behalf??
Notice how brazen Mexico has gotten with the US in the past 3-1/2 years, right about the same time the government started giving illegals their "rights"? If this crap claim takes on a life I guess our government is going to have to set up a special fund to give those special illegals money so that they can get the best defense money can buy.
As if Mexico would lay out any money to assist American citizens charged with a crime in their country. Why didn't Mexico provide her with an attorney and funds for expert witnesses? She is, after all, a citizen of that country, not ours.
How would an American, who did the same actions, be treated in a Mexican judicial system? Shucks, for that matter, how are their own folks treated?
I respectfully suggest, that foriegn nationals, when accused of crimes in the US, should petition their own governments for funds for appropriate defense.

Exactly! Heck, a U.S. citizen would be lucky to even have a trial. They dump millions of their citizens on us. Then, when they commit a heinous crime and get sentenced accordingly, they have the audacity to whine about their defense. Yes, let Mexico pay for the legal defense of their citizens.
Tell Nieto we'd have beenn happy to let her have the best defense money can buy, plus top expert witnesses as long as Mexico paid for them. Next time step up and offer to pay before the trial.
