There are Ag visas available for seasonal work. Called H-2A visas, there are approx 30,000 visas issued total in the program (very short of the need).

My fault entirely for being unclear - I was thinking of immigration visas, but somehow forgot to type it.

Seasonal visas for unskilled labor is actually a good idea, but as you point out, 30,000 is a drop in the bucket. If it's practically impossible to get one, then the program is of little benefit.

H-2B visas are available for "professional" jobs. This is more long term. However, they are rare and have MANY exclusions. Again, leading to being impractical...thus creating illegal immigration to be more attractive an option.

There is no cap on H-2A visas. Currently there are only 30,000 of them being used. That is not the cap for them.

"U.S. employers may petition for skilled or unskilled alien workers to meet temporary or seasonal needs in positions for which qualified U.S. workers are not available. It is important to note that the employer’s need for such services must be temporary. There is currently an annual cap of 66,000 visas for H-2B workers. THERE IS CURRENTLY NO ANNUAL CAP ON VISAS FOR H-2A WORKERS."

There may not be a cap, but there is obviously a problem in promotion and accessibility.

Could the problem possibly be that the users would have to pay better wages if using the legal process?

Weedsnake,

You are exactly right. The farmers don't want to use these visas because they would have to pay a legal immigrant better wages, provide housing and healthcare for them. They would be obligated to treat them like human beings rather than slaves.
