I was terminated for Misconduct because I was taping a meeting on my phone and taking notes. The company I worked for is going through lots of changes and we had rumors floating around that our group was being dissolved.

After the meeting, my supervisor asked if taped the meeting and I said yes and explained my reason why since we had a few people in our group that will talk over each other and it's hard to follow. I told him I deleted it and apologized and he said OK don't do it again.

The next day we had our usual one on one weekly meeting no mention of the tape just chatted about projects we were working on nothing special.

The following Monday (one week later) I was sent a link message asking if I was available to talk. I followed him and he said we were going to a conference room to talk with our new manager. Once we arrived I was told I was being terminated for misconduct. I never signed anything but was given several sheets of paper with items the field specialist would need to turn in if they were terminated none applied to me. I never spoke to our HR person just my supervisor and manager.

I had my Notice interview with IDES the man was really nice and I went over the sequence of events and dates. He was a tad confused why they waited a week to terminate me. He asked me questions about how long I worked there, how much I made, if I was ever written up, fought with anyone. I explained I got strong performer on review and that I was good employee no issues warnings or write ups. He was annoyed that they sent a 48 a page doc ( Code of Conduct) and I've read through and there is nothing specific in there except things like fighting, drugs, and theft is listed.

What do you think my odds are of getting unemployment? Also, would the employer be allowed challenge his decision?

Sometimes companies layoff people 'just because'. I know few persons at my past workplace who were laid off just because someone had to be to meet quotas (drawing the shorter straw i suppose)
You could try challenge but I doubt it would be of any use. Once management has made up their mind, nothing much can be done. I would say you were better off in a 'more honest' company.

Personal opinion - Taping meetings may be a no-no for many companies as they may interpret it as illegal means of holding important company related information which may be misplaced or fall into wrong hands. But certainly not lay-off worthy.

Take a couple of weeks off and start your job search, am sure you will find better opportunities!

First reply doesn't answer your question. DA!

Why didn't you google your question?!? Laziness?!?

Goggled it and found an answer in less than 5 seconds:

Generally-speaking, if you are terminated, you can collect unemployment insurance benefits in Indiana. But, there is an exception to that general rule in Indiana: If you were fired for just cause, you may not be eligible for unemployment benefits.

In my opinion, lazy people shouldn't get unemployment. They should be busting their humps to find a job!

Idk, all my Indiana friends who never had write ups ended up getting ok'd. It had to do with the employee never being warned, no write ups, not knowing that the job was in jeopardy.
The company will probably fight it but you should win .
Go to the unemployment forum for tips on how to not mess yourself up. Only you and your mouth can lose your money.

The plain fact is that Indiana is a "fire at will" State, meaning they can fire you for wearing a blue shirt on Tuesday, or no reason at all. You should still be able to draw unemployment but they will only be able to "dock" for a few weeks of it, unless you KNOWINGLY violated WRITTEN policies and procedures.

Any civil rights relating to worker's rights we had, Reagan and subsequent others have destroyed. Unfortunately, many are still laboring under the illusion we still have some until something like this happens and then they get introduced to the system that is SUPPOSED to help them, but really just tries to find a way not to. Good luck. I hope you find a less corrupt company with integrity, but these days, I have to say I doubt it. Watch yourself next time, no one else will.
