Would any of you lcam-ers have any answers to the following...... I live in a community that is still being developed, still under control of the developer. It is a gated community. Recently the developer, who in this case is also the builder, put to a vote a question on whether or not there should be a gate installed on an access trail that connects our community to the rest of Nocatee's inter-connected trails. The proxy was vague in that it did not specify costs , type of gate, it was not binding , it was subject to approval from the developer, etc. Enough of the homeowners voted to approve it, that the developer agreed to make the gated community truly gated by gating this access point as golf carts were coming into the community , from other communities to use our amenities. Recently the developer sent out a letter advising homeowners of a special assessment fee to help cover the cost of four gates . One of the gates will be installed this week. The 3 others are just out there someday , if ever, to be installed when and if the developer feels like it. My question is, can the developer demand that we pay a portion of the gates that , in my opinion, are the responsibility of the developer to pay for---- and if indeed they can, do we not have the right to then have a say in what kind of gates they install-i.e. key fob type, number pad type, etc. To me they are trying to have their cake, or actually our cake, and eat it too. Any help is greatly appreciated!
