Giving the tenant the benefit of the doubt, maybe they did try to buy a house, but were unable to actually secure one, due to unforeseen circumstances. I know lots of wannabe home buyers are unable to find a house because they keep getting outbid by others. (yes, it's a busy sales market for certain markets here) Or, maybe they did find one, but are having trouble meeting the financial qualifications of the mortgage company, or need more time to get through the financing process. If any of this is the case, it certainly would have been courteous for them to keep you informed, since you were making plans to occupy the property once they left. Side note: I've heard some people use the phrase "we bought a house", when all they really did was simply sign some sort of purchase contract.

All that aside, I haven't read where you said you got anything in writing from the tenant that said they agreed to vacate the property by a certain date. If it was simply a verbal statement, you could try to sue, but it would probably be a tough battle and you would likely not win. I agree with the posters above about your "get out if we tell you to" clause. That's a provision that is very likely unenforceable.

Ya, I mean I think you guys are right. Our best bet is that they are now carrying two payments. $1,900 to us and $[something similar]$ to them
