I have a contract with a realtor to sell my house in Las Vegas. I dislike my realtor and would like to get rid of him. The contract I have with him does not expire until April of 2009. Can anyone tell me how I can get rid of him and get out of my contract?

1. Ask him to cancel. Tell the agent you don't want to deal with him/her.

2. Ask the Broker to cancel. The Broker may agree or suggest another agent. Your contract is actually with the Broker not the agent.

3. If both fail you can go to GLVAR and request help. They have a limited role but sometimes will try to mediate with the Brokerage.

4. If they are doing something you think is out of keeping with the contract you can ask the Nevada Real Estate Division to help you

5. You can hire a lawyer. I don't think you can resolve a suit before your contract expires so you can't really sue...but your lawyer can write a strong letter.

6. Offer the agent some money to go away. If you make it clear he/she is not going to sell your house but you will give him X$ to go away it often works.

7. Wait until April.

We would give you the speech about being careful what you sign but we suspect you have given it to yourself already.

I don't know the answer to that, but once you figure it out, I just used a realtor to purchase a home in LV and did it all long distance from Rochester, NY. She was great. Her name is Angie Parks and she is with Liberty Realty.

Dear lvrichard,

Perhaps if you talk honestly with your agent about how you feel with his efforts so far, you may be able to turn things around completely. You need to let him know what your expectations are and see if, given a chance, he is willing and able to meet them.

If things don't turn out, though, just make sure if/when you fire your current agent, to interview several agents and ask for references from their recent previous clients before hiring a new agent. There are actually lots of great agents in Las Vegas, and you need to find one you can work with well. The agent and the seller are a team, and like any other team, personalities come into play. You and your agent need to be on the same page about marketing your home and have total confidence in each other.

When you are interviewing, also find out how much advertising your prospective agent does. Unfortunately many agents have had to cut back in these tough times, but rather than cutting back, they should actually be spending more to get their homes sold. Do they advertise in at least a couple of different magazines? Do they hold open houses? Do they have a prominent Internet presence and can you find their site using common search terms on the search engines like Google and MSN?

As Olecapt said, it is possible to break your contract. I formerly was a realtor and I can think of two occasions where my sellers decided to terminate their listing contract. If I remember correctly, they both expressed this to me first, stating they had changed their minds or did not feel we were a good fit and once my broker okayed it, the contract was terminated.

May I ask why you are feeling this way?

With all due respect to olecapt, who I believe is in the minority of ethical and good real estate agents, I would not count on much help from any other agents or brokers to aid you in this matter. I have experienced multiple instances where agents and brokers have wronged me in my quest to attain a home and their countermeasures to combat this are guarded by their own kind. I have attempted to file grievances with the GLVAR (greater Las Vegas Association of Realtors) regarding my issues and have found that door closed to me because they protect their own.

You may be able to find an amicable resolution via the broker as olecapt recommended, but only due to the fact that the broker will still get theirs.

Hey I quoted the procedures. Don't put opinions in my head.

My bag is at least 50% he will wait to April.

Listing agents are often the best salesman of the RE agents, work least and can be very hard nosed.

I recommend strong caution in dealing with anyone who mostly lists. Go for the mix guys. Particulary if the guy is a great salesman.

There is a little insider prejudice.
