I am considering moving from Canada to the US with my employer. I am eligible for both an L1-A and TN Visa. My question is this. Would I be allowed to generate a secondary income from a web based business that I created in Canada? This business would not benefit from my living in the US, but some of the income is generated from US members (i.e., it is a membership website). Any help would be appreciated. Thanks

If your aim is to apply for green card US in future, then you should avoid it.

If the income is for a Non US business it wont show up
on tax forms of US It will be only reported on Canadian tax forms
Immigration law doesnt forbid of having a business in any
other country They only concerned of unauthorized work or business in US

World wide income has to be reported and double taxation is avoided by international taxation agreements.

L-1A and TN have nothing in common. L1A will transfer you with your existing Canadian company to the existing US sister company as an executive/manager. TN visa will allow you to work in the US if a totally different company offers you employment. I have not seen a TN or L1A applicant in months... has to do with the grimm uneployment situation.

As far as you working a second job and getting paid by American clients... forfeits your legal status and can result in barring/deportation.
