Hello,

My name is Himanshu Goswami from India, living in Detroit MI for last 5 yrs. Currently, I am on a work H1B visa. My fiance is also an Indian national but lives in Finland right now. She is coming to visit me on a visitor visa (B2)in July. We plan to get married in the Wayne county court in Detroit at that time. However, I have few question regarding this:
1. Is it legal for both parties to get married when one party is on visitor visa (B2)?
2. When she moves to US later this year and gets a job. Will her H1B processing be affected because of this marriage in United states?
3. I am applying for my Green card soon, will this process affect my green card processing in any way?

Thanks you in advance. Looking forward for some answers.

Himanshu Goswami (Hugh)

Call the office that issues marriage license in Wayne County and ask them to help you.

They're not equipped to answer immigration questions and the OP is better advised to go to the USCIS website linked in the first "sticky" on this forum to find the right answer.

OP, when your fiancé moves to the US later this year on a visitor's visa she is NOT permitted to work on that visa. The USCIS website will also explain that and answer your other questions. Good luck!

Contact Ft. Wayne to get details on what documentation you and your fiancé need to get married there. Of course you can get married on B2. She will have to leave the US based on the conditions of her B2.

It will not affect her H1B application.

To the best of my knowledge her H1B and your Green Card application with her as spouse can run simultaneously. I would double check with the attorney preparing your employment based Green Card.
