Not sure. I thought windows that a person could fit through had to be part of it to meet fire regulations. Plus stuff like the furnace cannot be in the living space of the apartment and/or the apartment should not have the only door to the furnace room within it; it cannot have a gas stove unless the ceiling is X feet high, etc.
It's a basement apartment and that is more complicated than a "regular" apartment, as some basements are defined as "cellars" and never meet the requirements to have an apt. in them. (Not sure, but I think they are called "cellars" when they have very small windows and low ceilings?)
