So my secretary's neighbors converted a garage with a 2nd floor extension into a legal apartment - got all the permits and the Town of Hempstead signed off the deal. But the apartment is supposed to be only for family - which it was - but the mother died. Now the neighbors started renting it to non family & the people living there are driving the secretary crazy with all the parties and company - taking up all the parking and just loud. She told the neighbors she was going to report them if they couldn't tone down their tenants and the neighbors said they have every right to rent it - the whole thing was done lawful with the TOH blessing. But she thinks its only supposed to be for the mother - or at least for family - and once they started renting to strangers - it "voided" the legality of the apartment. Anybody been faced this and know what the deal is?

If it's legit probably not much can be done other being a ball buster.
Keep calling the cops and complain, build a nuisance case.
Probably still won't make the issue go away but maybe enough pressure applied for them to tone down the festivities.

I don't know that much about mother-daughter apartments so I could definitely be wrong but I always thought they were for family members only.

It's supposed to be for family only. I don't know about TOH, but in Babylon, you have to have a rental permit from the town if you want to have tenants. I highly doubt your neighbors bothered to get one.

This has become a common occurrence in Lindenhurst, particularly since Sandy. Lots of houses being rented by homeowners who were unable to sell after Sandy. Its one of the main reasons I'm looking to move elsewhere. Often renters do not care about the appearance of the homes they live in as they don't have a vested interest in it. I suppose you could report someone who is illegally renting out their home to the town. Whether they will do anything about it is another matter.

The Town of Hempstead has two options for rentals.

One is a Mother/Daughter. This must be a true family relation. It is renewed every few years and must go before the Board of Appeals for initial approval and then renewals.

They also have a Senior Residence. This applies when the Homeowner is over 62 or so and then you are allowed to rent the apartment to non relatives. This does not have to go before the board.

If the neighbor is not over 60ish, then it should be a relative renting the apartment. Then can contact code enforcement and let them know that the family relationship situation is no longer the case. Or they can just wait it out for the renewal process and complain to the board at that time..

Yea tip off the town that grandma is dead they are supposed to dismantle the changes and back to original design when its not mother daughter anymore. The inspector will validate whos living there. Good luck

Thanks - looks about 60 ish - so probably the MD got converted to the senior rental apartment then
