Okay my cousin just got a letter in the mail to appear in court for non payment of rent,and I'm wondering if she pays it before her court date will that stop the process of eviction? I'm also wondering can they use the same court case of non payment of October rent for November rent and she is still living there. Since she hasn't paid November either.Are would they have to do the eviction process again for November rent in December? And also my cousin has been trying to reach the lawyer who is representing her landlord so she can pay for Oct rent but the lawyer isn't ever there? What can she do?

Judges on Long Island tend to by sympathetic to tenants. If she pays October they will probably give her some more time to come up with November. I'm not a lawyer. Just what I have observed.

Thank you for responding.She has also explain to me that she has went to management office to pay Oct rent but no one is ever in the office. And I can agree with her since I went with her several times to go trying to pay. She has even call the lawyer who is representing the landlord in this case to make payment but she isn't there and when she calls the lawyer doesn't pick up or call her back when she leave a message. The next thing is faxing her. So what can she do? Any advice?

It is extremely difficult to evict someone here in the nanny state.
They could be dealing drugs, rapin’ and murderin’ everyone and still not get evicted without the due process. They could go to jail and still be entitled to the residence.
It sucks but it is what it is. It’s a risk you take being a landlord or even trying to be a good friend. You let your homeless friend stay with you long enough to get mail delivered in their name and it’s their “legal residence”.
On the flip side, if you’re a complete deadbeat derelict then right here is the place to be.
Play your cards right and you’ll never pay rent. Just be prepared to move every year.

OMG! That's sounds awful.LOL But sadly for some reason I can't disagree.

If there is enough time between now and the court date, I would send the check to the management company by certified mail, return receipt. Then, when the return receipt card comes back to you fax a copy of it, along with a copy of the check to the attorney. Keep all of the paperwork and show up in court.

If they want to evict her, they won't accept the payment. If they do, they will have to refile again for November's rent.

Default inability to pay the rent

is not excusable in Nassau, personal experience is judge will send you packing.
