Hi All,

I am looking at houses in Nassau county Land record website, I see there are houses listed with property code as Two Family Year-Round Residence. Does it mean it is a legal 2 family houses? If I bought the house, I can live one unit and another unit for rental?

Also, there is another house I saw with property code as One Family Year-Round Residence with Accessory Apartment. What does it mean Accessory apartment and how does it different from the Two Family Year-Round Residence?

One last question, does the property code impact the property tax?

The description you're seeing is the county's assessment of the dwelling use. It doesn't necessarily correlate to approved usage by the authority having jurisdiction. Check with the Town/Village where the dwelling is located for the most accurate information. Some may be full two-family grants, others may be temporary with regular renewal periods, or special use (mother/daughter or senior accessory apartment) that cease upon transfer of title and carry certain residency and other requirements. Some may carry an owner occupancy requirement, whereas others may be rented out entirely as an investment property. Others may be straight up illegal conversions or apartments.

As said above, the assessor only inspects for taxing purposes, the structure does not have to be approved by the local jurisdiction to be taxed. Its a county money grab so be careful and check with the town or village building dept to see what they have in their records

Thank you. So in another word, if the owner does not agree with the assessment property code or it does not match with the town's approved usage, the owner could submit a challenge to the town assessor to update it?
