We have a tree in our yard and some of the branches are growing over the fence a little bit into their yard it’s Highup it’s about 10 feet over the fence but it does go over their pool by a little bit. Is it a responsible to cut these branches or their’s?
Some are quite big so would require a chainsaw. Thank you

Overhanging Branches on Your Property

Even if the tree trunk is on your neighbor’s property, you have the responsibility for cutting any branches that extend onto your property line. You are responsible for the cost of cutting any branches you choose to trim.


You can cut back anything up to your property line. You must take care, however, that any maintenance you perform on the tree branches does not damage the rest of the tree.


If your actions cause damage or ultimately kill a neighbor’s tree, you may be found liable for up to three times the replacement cost of the tree. Depending on the size and type of the tree, the typical replacement cost can be anywhere from $500 to $3000. Some rare trees can be valued at tens of thousands of dollars.

I’m confused by that is it just me I don’t follow are they saying anything from a tree that’s in your yard that extends over to their yard is your responsibility

Oh never mind I guess it’s my neighbors responsibility to cut the portion of branches overhanging

Bottom line is you don't have to, but if they want them trimmed, they can trim anything they want that hangs over their property, to the property line.

To add: as long as that trimming doesn't kill the tree.

If you don't know where to make the cut in a branch, that alone can damage a tree: insects can easily invade the tree through the opening left by a poorly cut/unpainted wound.
