Hello everyone. The tree in front of my house on the curb is diseased and dying. I want to remove and replace it with another tree. I'm pretty sure I have to deal with the town (TOB) on this. I'm not sure it's worth it dealing with TOB and their inspectors. Anyone have this done? Thanks.

TOB = Town of Babylon?

If so, according to the town:

As such, these are the responsibility of the Town and will be maintained and/or removed by the Town. The Town is very dedicated to the preservation of trees and will only remove a tree as a last resort or during road reconstruction projects.
In practice, it might take a bit of escalation on your part to get them to actually do something. I went through a situation not too long ago. Town came out, tried to argue it was my tree. After measuring, they agreed it was the town's and would take care of it. As soon as they left, I received an email claiming the inspector determined it wasn't a town tree. It was, and he lied to me when he said the town would take care of it. I went over their head at the town and received a favorable result.

It was worth the extra effort. What I didn't bother fighting is the replanting. I wasn't going argue with the town only to have them _maybe_ plant some horrible little thing. I bought my own replacement and had it planted. Did the same with several trees that are on town property adjacent to mine. Decided that fight wouldn't be worth the trouble.

Thanks for telling me what you did. I am talking about the Town of Oyster Bay in Nassau County. I can deal with the Town, I just don't want them trying to find things once they are over here checking the tree causing extra misery. I wish I could just cut it down and replant another tree. It's a relatively small tree. We all pay so much in taxes and we have to just deal with the nonsense. Thanks again.

Those clowns in oyster bay will actually charge you for a new tree! When they cut down the one in front of my house. (I didn’t want it removed) they asked if i wanted it replaced I said yes. Then they told me price, iirc it was $50 or $75 7 years ago. I didn’t have the tree replace either did anyone else. And the street looks terrible now. We have since moved so I’m glad I didn’t pay for the tree.
