I have a dangerous person living on my property who shouts obscenities and threats to my family. The sheriff is at least 6 weeks behind in scheduling the legal physical eviction (and maybe more). If I have him arrested, does that delay the process? Is there any way I can move our case to the top of the list based on this?
Plant a pound of cocaine in the house when he isn't around and then call the feds...
Seriously though, aint much you can do in a short period of time.
Too much legal red tape.
I don't think getting him arrested would make a difference either way at this point.
Best bet is to contact a lawyer who specializes in housing cases.
Already have a lawyer but am stuck with a legal eviction that could take 2-3 more months to come into effect. The laws really suck for honest landlords!!!! I've called the police twice and will definitely get an order of protection if necessary (good idea). Yuk to the process!
Contact the Police Department and ask to have it documented that you feel threatened about the individual. Ask for an incident number. Explain to the officer that you don't wish to have a full-blown report initiated, but you just want some things noted in the details of the call. Have the subjects name, DOB, address handy.
Next, contact the civil bureau of the sheriffs office. They have a unit specifically for evictions. Ask to speak with a supervisor. Tell them that you know they are busy, especially in this economic climate, handling evictions, but you feel threatened by your tenant. Tell him that you have already filed the necessary paperwork, and you now have spoken to the police department and had it documented. He may ask for the incident number. If he doesn't, offer it. Ask him politely if theres any way you can have this process sped up. Other than that, good luck.
The S.O is VERY far behind these days because they're getting swamped. I was told by a deputy friend of mine that evictions have gone up considerably because people simply can't pay their rent/etc.
Don't approach the person on your own. Leave the messiness to the good guys.
This is great advice. The police have already been to my house twice so I'm calling them tomorrow to get the incident numbers. Then I'll call the sheriff's office, as you suggest. Hopefully they will listen as this person is on my property (it's not just a big apartment building) and is directly threatening to my family. Wish me luck!
if he you have him arrested, it gets him out right then and there. an order of protection is filed and you can tell the police you dont want him near you or your family.
I'm in Nassau County. And I will call the police in a second if there's another incident. Just want the person OUT!
Definitely do so if he behaves violently or threatens anyone with violence.
If they try and weasel out of arresting him, tell them you will be calling Kathleen Rice's office ASAP and you will be telling her people in the District Attorney's office your situation and how they refused to help you get this dangerous person away from you. That should light a fire under their butts if necessary.
