What is the process to get a variance? How long would you expect it to take? I have a small shed a few feet in front of my house, and Huntington doesn't allow shed in front yards.

Go to the Town Hall on Main Street - they will answer all your questions there. It's good to hear that a shed isn't allowed in the front yard - what an eyesore.

I was hoping to get some info before I go to town hall. Our set back is 120 feet from the road and only part of the shed sits 4 feet in front of the house, most of it is in side yard and its a nice looking shed, though i can see why the town code reads as it does..

Has anyone gotten a variance, how long did it take?

I don't know what it's llike in HUntington but I believe it's the same everywhere, or similar - you have to apply for the variance and then you have to go before the zoning board and state your case. Here in Garden City, anyone whose property touches yours can sign off on it prior to this happening, but unless you get everyone's signatures, it's a no-go. We refused to sign our neighbor's multiple page variance request (as did all the neighbors) for stuff he already had installed. Then the town sent us letters advising us when the hearing was, and we could send letters instead. We all sent letters and he got the variance anyway. All this to say - it's going to cost you time and money, but you'll probably get it anyway.

If there was a variance on my house for the previous owner to add a addition, does the variance still apply if he sells the house, neighbor is trying to build a fence on the property line which in turn will create a problem for the gas meter and my exit door. Spoke with the previous owner and he said he had to go in front of the common council and get a variance to build and of course it was approved. Now niagra mohawk says, if he puts up a fence, we come shut off your gas and we have to move the meter and charge you to do so.

This would probably cost you less in the long run too. They have been increasing all the application fees (and any other fees) to generate revenue in Nassau, I would imagine its the same in Suffolk towns too.

You have to apply for a permit, get denied and go to the Board of Appeals. Huntington Town also charges 4 times the fee to maintain something that exists prior as opposed to getting the proper permits first. Your fee will be a lot of $$. Moving it behind the house line may actually be cheaper...

I used a rubbermaid shed from home depot put together myself that is 10x10.

My town says a permit is needed for any shed made of wood, steel aluminium or concrete or any shed on a permanent foundation.

Also says any shed greater than 10x10 needs a variance etc.

Guess what a rubbermaid shed does not fit the definition of needing a permit.
