Hi
Question, my rent has been at $1550 month to month for the last 2 years years and all new tenants are moving in at $1450 which shows on the complex website. Can they legally keep us at a higher rent and let them in at the lower price. 58 units and most have been here over 2 years that are paying the higher amount. If I went and ask for the lower rate would they be obliged to do so? no rent control area, Torrance, CA, No leases

Of course it's legal. Would you be complaining if new tenants were being asked to pay $1650 while you paid $1550? They're not obliged to lower your rate but you're not obliged to stay there more than another month. If you're paying an above market rate, move if they won't lower it.

Yeah, no legal issues there. Ask them to lower the rent, and if they don't either move, or request to move INTO one of the $1450 units.

If you're still in a lease agreement, then you bet your ass you are contractually obligated to pay the 1550. Now if your lease is up and you've been month to month, by all means try to renegotiate it down. Hell, try to renegotiate it down even if you are still in contract. But don't expect them to roll over if the lease agreement is still valid.
