Hi, I had deposited money to the seller for transfer the store. During process paper works for buying the place. The seller called to cancel the contract, but still holding the deposit money and says will return when the she got the money..Could she/he keep this money ? and when can I bring them to court? Thanks

Laws vary by state I believe. You need to contact an attorney. The money should have gone to an escrow account through an attorney. That's how we've done ours with every home we've ever purchased. Guarantees if anything doesn't work out you get your money back with no problem.

Wow. The money needs to be in a trust account, which can only be used for deposits and not operating expenses. Is either side using a real estate agency or attorney?

It sounds like this was a private deal with no brokers involved. Depending on the amount of deposit, maybe hvnguyen54 could go to small claims court.

Try Pine Tree Legal - ptla.org. They focus on helping low-income people with disputes but if they can't help you, I imagine they could point you in the right direction. Their website has lots of info and has helped me iron out a few issues in the past without ever needing to go as far as calling a lawyer.

I very much doubt that either they or their land is anywhere close to Maine.

Judging by the grammar in the OP I think the buyer is from South Asia or the Middle East. The seller could well be in the USA and trying to unload some convenience store.
