I bought a house on May 8th 2015 with my wife using my VA home loan. We had an independent inspector check the place back in April. Then the VA had someone go see the house also back in April. Me and my wife had only been in the house three times before we signed the paperwork. One the first walk through where everything looked up to par. The second time when the independent inspector did his thing and wrote up his report. Then the last time was with the Real Estate agent the day before we closed.

This is where I need help to figure what to do the house was an as is sale. We asked them to fix the water heater and they did. Then the night before closing we are doing a walk through and find 5 broken windows. We emailed the listing agent and they refused to do anything about it. I went ahead and emailed the independent inspector and asked him did he look at the windows and notice if they where broken.

The inspector is willing to sign a statement saying he checked every window in the house during the inspection.

Now I am not sure what to do with an "as is " sale. Can someone help me in need for some advice.

Confer with your real estate agent. That was the point of the final walkthrough - to notice if anything had been damaged since inspection. I take it that you decided to close on the house, despite the damage you saw? It's likely that that's the end of it then, but your agent will know for certain. It doesn't make much sense that someone else would be liable for the damage, if you knew of the issue and decided to complete the purchase, anyways.
