Good afternoon

I’ve been filling as head of household for several years , even I’m still married and living with my husband. But I paid more Than half of the expenses for our home and daughters . We always filed separately cause he doesn’t have a social security number. Can I get in trouble for that ?

You would probably be well-advised to contact either an accountant or perhaps better an attorney who knows tax law for a correct answer to your question.

Does your husband have any income? Why doesn't he have a SSAN? Not any of our business but it might have a bearing on your situation. And you say you file separately which "seems" to indicate that he also files, but without a SSAN?

You may need much more help than you can get on a forum such as this.

I believe filing head of household implies you are single with children or other qualifying dependents and unmarried, or married and living separately. There are certain exceptions if your spouse is a non-resident alien whom you do not claim on your tax returns. As was mentioned above, you would be best served by seeking the advice of an attorney.
