If one purchases a home this close to a golf course what is a reasonable number of errant golf balls one can expect to hit their home or land on their property? Turns out 651 was just too many for these folks. Thought they were walking away with a 5M settlement but looks like the judge made an error during trial and now a re-trial is needed.

An opportunistic way to try to get multi millions and never have to work again a day in their lives or was there honestly mental suffering endured from the errant golf balls hitting their home?

I think its understandable that if your house is getting pelted with golf balls you'd live with some fear and mental anguish. Hard to say what the dollar value for compensation should be for that.

From doing some googling I see the 15th hole on this course is a dogleg left. Unfortunately the house is at the crook of the curve so anybody playing aggressive and trying to bomb the tee shot over the trees has a chance of hitting the house.

They shouldnt have been awarded anything. The gulf course was there before the couple was. Its like people who buy a house next to a shooting range then complain about hearing gun shots.

I'd say maybe the $100K they were awarded for damages to their home is justified but the $4+ mil for emotional distress seems extreme. Since this home has been in the news so much, I guess their biggest issue might be selling it if they decide they ever want to move. It'll be interesting to see what the verdict of the re-trial is.

Even the 100k is uncalled for. They knew what they were buying before hand.

I was honestly shocked these folks got a dime for anything. I'm glad the verdict was overturned. IMO it was ridiculous and did not abide by the law.

I can't remember the legal term but basically if you live on a golf course it's implied that your house is going to get hit by golf balls.

We live on a golf course in South Carolina and our house hasn't been hit yet. Maybe we have better golfers?

It really depends WHERE on the golf course you live. My parents live on a golf course on Cape Cod and their house backs up to the side of a tee box. It would be REALLY crazy if a golfer hit their house.

Conversely, I played this summer at the Cape Club in Sharon and they're building townhomes on every available inch of the property. The 18th green has homes that are VERY close to the green. I'm sure those homes will get struck by a ball several times a day and likely will frequently have broken windows.
