I am confused. My aunt had done loan modification for her house in Miami 6 years ago. She had taken advice from loan modification company of not paying her mortgage for 3 months, did the loan modification got a new loan company. She has been paying her mortgage without any problems or late fees for 6 years. She gets a knock on the door a week ago, from a lady saying she was the new owner of the house. Turns out that my aunts house was sold at auction for $40,000! She is now scrambling to get with a lawyer and fine out what is going on. Her current loan company says that on their side everything is okay.


Has this happen to anyone else? What are the chances she will lose her home?

Terrible "advice". This is never a good idea! It sounds like your aunt was scammed.

Not paying your mortgage = foreclosure

That's what I thought. Although, she was never served any type of foreclosure paper.

Something doesn't add up. Foreclosures don't take 6 years to happen. Tell your Aunt not to open her door to strangers also!

6 years is how long she had been paying her mortgage for, not how long the foreclosure took.

She needs to be served notice of the case and sale. Without notice the whole entire foreclosure case and sale would have to be undone. Honestly, it sounds like somebody scammed or is trying scam her. Whether it be the modification company or the person claiming to now own her house.

She needs to go see a lawyer TODAY, with every document she has to figure out what happened. Today. Go on a site like avvo and find a good lawyer and see them ASAP. No delay.
