Well, we were served papers today that our landlord has foreclosed... no surprise really but I hate it all the same. I believe he has also left the country since I have no contact details anymore as all have been disconnected..
Anyhow, aside from having to fill out the papers and mail them back- anyone else, unfortunately experienced with this as a tenant and can you offer some important advice???

Thanks a lot ArcticPhoenix and blacklight for your sincere thoughts. Why would you post something like that?

Does anyone have any idea how long this process could take? We are suppose to return the papers within 20 days ( I will wait until the last day). Then we were told we would have a court appearance. I have no idea when that would be and what takes place after that.

Anyone with experience with this?

Sorry to hear you are going through this. I would guess that there are probably a lot of other people in the same boat in the current economic climate.

What exactly are the papers that you were served with? I (thankfully) have no experience in this realm, but my first guess would be to look into getting a lawyer on your side, or at the very least seek out legal advice. I would think that there must be some organization that you could go to for assistance, considering that there are more and more people facing this situation across the country.

Start looking for a new place! You will all the sudden discover that you have to vacate that dwelling, and in order to find a good place with a lengthy application process without spending time in an extended stay motel, I would suggest you start submittng applications in to other buildings.

The papers that you received today, what did they say? Did the papers indicate a mediation or foreclosure sale? If they indicate an actual sale and give you a sale date, then you have 10 days past the actual sale (on the courthouse steps).

Normally, the 1st set of papers are for mediation. Basically the bank tells the court that the money is owed and the house is collateral. After that there is a 2nd set of papers informing of the sale date. Then after the sale takes place, the bank has to wait 10 days.

I worked in Loss Mitigation for a number of years in the mortgage dept at a bank.

Until you receive the actual sale date, you are safe. Down here in Monroe County, it is taking 6-9 months to get a sale date because the courts are so backed up. Under normal circumstances, it normally takes 30-45 days, but this is anything BUT normal!

Firstly, thank you for the information.

The papers state

"CountryWide Bank"
Plaintiff
VS
My landlord, et al.,
defendants

Summons
Personal Service on a Natural Person

To Defendant:

Unknown Tenant (that would be me and my family)
address...
(Def #04)


Then it states we have 20 days to reply to the summons .

Another page states
Complaint to Foreclose Mortgage and Reestablish Mortgage and Reformation of Mortgage

Smtisland

What does this all mean? Thank you for your help

Means that the landlord is being foreclosed on.
I'll get hammered for this, but here you go.
Stop paying rent (if you haven't already) answer the summons and if you want to stay in your present dwelling, you can probably drag this out for months if not longer.
If that is what you want to do, you'll need an attorney, his strategy will probably be to demand to see the note that the landlord signed. Since Countrywide no longer even exists and since most everything is in chaos right now, it would not surprise me if you stayed there a long time.
As to the morality of this, I leave that to you and your beliefs and please do not explain it to me.
