it is tragic...but it raises another issue. The people that own the home can be sued by the family of the child that was killed.


Nobody can know when a tree is going to fall. When you allow people to come trick or treating on your property, you are liable for what happens to them.

I think it would be terrible if they sued that family. They are heart-broken about the whole thing. My friend was there - witnessed the entire horrible ordeal. She said the wind had calmed down for quite a while and all of a sudden, the boy was there, the wind gusted, the tree snapped and he was hit. It was all a matter of the wrong place at the wrong time - total accident. SOOO sad.
What good would come out of suing the homeowners anyway? That poor boy is gone. It won't bring him back, it won't change anything. A horrific accident occured. That's it. Plain and simple.
I feel very fortunate to have my son here with me today - he's the same age as that boy - and it sure puts life into perspective hearing the story straight from a witness...who also has children that boys age - IN that boy's town. : (

So sorry to hear of this tragic accident. My prayers are with both families and friends.

Two of my children were sick so we baked cookies, had our own Halloween parade, took pics and had a treasure hunt. It was reported that this Halloween would be especially dangerous for pedestrians(I guess being a weekend night increases risks of vehicle/pedestrian accidents) and children were at higher risk, so I was okay staying in and knowing we were all safe.

Sounds like that was a fun Halloween for you Cindy! : ) Sometimes it's nicer to stay out of the hustle and bustle and be home with family.
