I live in a 3 family home in Bergen County, NOT owner occupied. One couple on 1 floor constantly smoke marijuana and it rises up to my floor causing health problems for me (migraines, etc). The person utilizing the substances also receives Section 8.

I have addressed this with my landlords but to no avail; they refuse to do anything. I have notified Section 8 and they are trying to help as best they can but again there is little they can do. In addition, I have tried to call the police to come every time there is the overwhelming odor of marijuana smoke and they are powerless to do anything without probable cause.

Does ANYONE have any suggestions?

Sounds like you've taken the right steps. The only other call you could make would maybe be dept of health. You may want to physically go talk to the police instead of just calling. Good luck.

Right, that's what I was going to say. It sounds like you've spoken to everyone BUT the neighbor. Maybe they have no idea people outside their apartment can smell it and would want to stop that from happening.

Marijuana does not cause migraines.

If you didn't first approach your neighbour about the situation before calling the police, chances are you have burnt some bridges and your neighbour would do well to tell you to buzz off. Now you must reap what you have sown.

If you hear a fight downstairs call the police about that. I called once on a downstairs neighbor for hitting hsi wife. That would be the probable cause, then they could investigate the strong odor of marijuana. A noise complaint might work after 10pm also.

Maybe take your lease to a lawyer and see if there is anything in there that you can use to make the landlord do something about it? I know that sounds kinda mean but I can't think of anything aside from moving out.

Allergy to smoke as well as odor sensitivity can also cause migraine headaches in some people. I think it is just the smoke. Not necessarily the what they are smoking. Then again the OP may have a sensitivity to the smell that is triggering the headaches.
