So the buyer bought the house, and it already had a patio. Nobody cares, including the town, that there is a patio there. I would say at this point it is your problem if you buy the house... approach it this way. Or you could approach the seller and say you want it fixed/inspected as a condition of your post inspection negotiations.

has it been determined if this is a wood/composite patio(deck) or paver patio? i have a paver patio and did NOT require a permit since it's not considered a permanent structure.

In Manalapan, I was required to get a permit for a shed that was there when I bought the house 13 years earlier. My deck did not have rails so I had to have that installed by a Handyman to recieve the CEO.

A deck permit ?
The only thing that is inspected (in most towns) for a deck is
how deep the support posts are,
Are they anchored in cement
is there a railing (usually all decks require one, even ground level, had
that argument with my inspector)
and how far apart are the balisters
that's about it.

waste of time/money
