Quite frankly if that is a possible cause of the mva, getting a subpoena for the call data isn't a big deal. This legislation isn't worth the effort. Unlike a dwi, the evidence will not dissipate over time.
The driver could be reading a text, surfing on a smartphone or simply tuning the radio, switching the connected Ipod or watching the GPS. Today's cars are loaded with distractions. A cellphone is only one of them.
IMO and others including experts who have researched this is that you are still a distracted driver if your engaged in telephone conversation while driving.
No it's not the same as listening to the radio, that's background noise.
Yes I know I'm an old fart who doesn't understand why people have to be in contact with others 24/7.
I understand that, however it is not illegal to talk on a hands-free device, so there is still an area where I don't know how they'd discern that.

The world is not perfect, accidents occasionally happen. Would you really feel better if the cop checked her phone and gave her a $100 ticket?
Too many laws out there for me. They should have one for the dummies in the supermarket that are on the phone in la la land going down aisle after aisle. They should tack on 5 bucks at the register for clogging up the aisle.

Yeah, but you're not going to kill someone's family member by hitting them with your cart. Talking on the phone is one thing, but texting really should be severely punished.
We will probably have these discussions until some time in the future when we just swallow a communications chip and it channels our conversations and thoughts to whomever we direct it to. Even then some politicians will want to regulate and ban such activity.
I see talking while driving often, the one thing that really bugs me is when someone is SO clueless they are on cloud 9 in the left lane doing it. Looking for the vaporizer control on my console to take care of that.
Why take the phone at all? They can subpoena your billing records and have documentary evidence of your being on the phone. They'll even know if you dialed or answered.
