So I have a general question that I hope someone can answer.....I live in California which is a community property state and my husband has an unemployment overpayment that is to be taken from our tax refund this coming tax season....my question is can I file the form 8379 and expect to get anything back....he has not made any income this year all he has is he student loans.... (the overpayment occurred right after we got married)....I have been the only one to make an income this year.....any help or information about the topic would be helpful everything that I have read is a little bit confusing

You should ask in the California forum. That might be less confusing.
