Hello,

My family and I have been leasing a home in Monmouth County for the past 4 years. We have a yearly lease which we renew.

Given the economic uncertainty I am considering not renewing my lease this year. (My wife recently lost her job and I work in financial services, in NYC.)

My question is, do I have the legal right to turn this into a month-to-month tenancy? Someone told me this was possible. I don't want to lock in to an expensive lease for another year.

Any and all comments appreciated.

Unless both parties agree, If the LL presents you with a new lease, (with REASONABLE changes) you have two options, accept it, or move out. Check with your attorney for legal advice.

Post this on Lawguru.com. Some landlords will allow you to go month to month others may not.
I hope your wife finds a new job soon!
