I feel all US citizens should hear it especially those in New Mexico.
Synopsis:
According to KOB Channel 4, Deming Police stopped a man, David Eckert, for running a stop sign leaving a Wal-Mart. They asked him to step out of the car and he appeared to be "clenching his buttocks" so they called in a warrant to do a body cavity search.
They took him to a hospital and this is what ensued:
1. Eckert's abdominal area was x-rayed; no narcotics were found.
2. Doctors then performed an exam of Eckert's anus with their fingers; no narcotics were found.
3. Doctors performed a second exam of Eckert's anus with their fingers; no narcotics were found.
4. Doctors penetrated Eckert's anus to insert an enema. Eckert was forced to defecate in front of doctors and police officers. Eckert watched as doctors searched his stool. No narcotics were found.
5. Doctors penetrated Eckert's anus to insert an enema a second time. Eckert was forced to defecate in front of doctors and police officers. Eckert watched as doctors searched his stool. No narcotics were found.
6. Doctors penetrated Eckert's anus to insert an enema a third time. Eckert was forced to defecate in front of doctors and police officers. Eckert watched as doctors searched his stool. No narcotics were found.
7. Doctors then x-rayed Eckert again; no narcotics were found.
8. Doctors prepared Eckert for surgery, sedated him, and then performed a colonoscopy where a scope with a camera was inserted into Eckert's anus, rectum, colon, and large intestines. No narcotics were found.
I think this is an important issue that it be posted here since a lot of posters here probably live in New Mexico. Sadly, it has only come to national attention recently because of the lawsuit Eckert filed.
The police misconduct is troubling at best, but even more troubling was the complicity of the doctors involved.
I vote when the seven- to eight-figure settlement or judgment comes through, it gets borne by the doctors and law enforcement personnel involved, not the individual taxpayer, who already suffers enough from incompetent police and doctors.
This episode was repeated with another individual, too. Someday hopefully probable cause won't rest with an out-of-compliance police dog with a history of false positives.

Well, Homeland Security has a new opening for an attorney in southern New Mexico. Once can only hope this means more oversight of the day-to-day insanity.

I guess you're right. If the KOB Channel 4 reports from the traffic stop and the medical reports are accurate I would say that "Misconduct" is the most benign way to title this behavior. If it turns out as bad as it appears now, I would call it criminal assault and gross violation of the constitution.
But I understand you changing the title of the post.
Demings got a population of 15,000, I can't imagine the city being financially solvent at the conclusion of this case. Seriously. This isn't even the only case, there are two cases.
The sheriff who said his deputies followed correct procedures isn't helping either. Correct procedures do not involve doing these kinds of searchs. Let alone with invalid warrants both due to the stated nature, the expiration thereof, and the execution in a county in which the warrant was invalid.

Was he given his right to speak with an attorney before the tests were started.
Seems that maybe his right was violated. Was he even given his rights?
If so, then why did he not or did he speak with an attorney?
