water the adjoining parcel if you buy it?

In other words I'm closing on an orchard with 40 acres and sufficient water rights to water the 3000 or so trees on it. I've been offered the adjoining property just raw land with no rights.

Can I extend my lines to that property and plant some nut trees?

There is no simple answer, at least none I would depend on. First, it depends on where the parcel is located. Check with these people: New Mexico Office of the State Engineer / Interstate Stream Commission

Yes i have an email in to them. The response has been "Out of the office until ...." Parcel is located in Tularosa and its part of the Tularosa Basin.

According the NM Engineer If i transfer rights from Parcel A to Parcel B than I must leave Parcel A unwatered. It doesn't seem like I can use some water on both.

If anyone is interested I can post both his response and the water rights summary.
