I saw that Section 8 tenants are forced to move to a smaller apartment if their family size changes--does anyone know if the same is true for 80/20 apartments? For example, if you have a 2 bedroom apartment and your child lives there and then moves out when the graduate, are you required to move to a 1 bedroom? Thanks!

I don't believe that will likely happen, however you should be open to it if it is required.
Remember you don't own the apartment and if you keep a larger apartment you are depriving a larger family in need of a home, a family with children they could be currently living in a shelter.

Most of these 80/20 developments are rent stabilized, and there is nothing in the law that says people must downsize. In fact, in my development, we are rent stabilized (not 80/20 though) and some residents want to downsize, but management is saying that it's too complicated.

Some 80/20 leases contain a clause that states that a 2 bedroom apt must be occupied by at least 2 persons; I suppose it is up to the mgt. co. to enforce this policy.

I had a client in july (im a real estate agent) who grew up in an 80/20 building. She took a place i showed and it was a bit of a situation at one point because the management told the parents and her once she moves out the daughter had no more legal right to move back in the apt and was to be removed from the lease. Her parents can keep the 2br apt but cant add the daughter on the lease again. They have lived there for 17yrs if im not mistaken

I guess the management is trying to avoid succession rights. I don't see how they can prevent the daughter from moving back in though.

Default Can section 8 force people to downsize from an apartment they lived in for 30 years???

Can section 8 force a person who lives in a 2 bedroom apartment to downsize to a 1 bedroom apartment? The person is disabled, pays their rent on time every month.

This was not mentioned in the meeting when section 8 paid the tenants a visit. I never heard that section 8 can force a person to move to a smaller apartment, who is disabled, living on the first floor.
I have been living in this same apartment for almost 30 years, why do i have to move to a smaller apartment, when i have grandchildren who come and visit me and spend time with me. Where do they supposed to sleep, on the floor in the living room???

Apparently yes "they" can and have been able to do so for quite some time.

Question isn't about 80/20 multi-family or even rent regulated units per se, but who is paying all or most of rent.

With a voucher such as Section 8 the city very well may be able to "force" a tenant to move from larger apartment to smaller. Isn't so much to do with size of apartment but rather rent. Studio and one bedroom apartments generally cost less per month than two bedrooms.

Unless, when or until you receive such a notice I wouldn't worry about it.
