My uncle is looking to apply for affordable housing, but he has some issues. He is married to a woman, but they are getting separated. His wife receives social security, and they filed their taxes together last year, and the asset that she has is a condo, I'm not sure if it is fully paid off, or if that matters.
He wants to get apply for the affordable housing since he will be moving out, but my question is, when applying for the affordable housing, will her income be attached to his since they are still married? How will that affect his housing process?
Also, he works as a nanny essentially, and he gets paid cash, how does he prove his income, since there aren't any pay stubs?
New York isn't a community property state. He may actually have no interest whatsoever in the condo.
If they've formally separated or have lived six months apart and can demonstrate it (may have to do an affidavit) his soon-to-be-ex-wife will no longer count as part of his household, which means her assets will no longer count, either. See p. 39-40 of the marketing handbook.
