Hey! I submitted an appeal over a year ago after being denied an apartment even though the marketing agent took me to view it in person. Has anyone else ever dealt with this? Like, they can just get away with completely ignoring you? I submitted my appeal on the housing connect system but never heard anything back and that seems not ok to me, especially because I really do believe it was a marketing agent error and that my appeal is legitimate.
I do understand that these marketing agents are completely flooded with applications and inquiries so it’s possible it can take years to get to my case, but my log number was only three digits and I feel like at least they could dignify me with a receipt of appeal. Furthermore, I lived in the community board of this building and that was a preference in this lottery.
Am worried that even if I were to one day get a response it’d be too late and all the apartments in this lottery would already be leased. For what it’s worth, it was a big lottery. There were over 120 units up for grabs. (However, only 25 of which was I actually eligible for)
Call HPD ASAP. I believe the marketing handbook says they are supposed to respond to your appeal within 14 days and are supposed to hold an apartment for you in the meanwhile. A year doesn’t sound right.
Thank you so much for the reply! Do you know the contact at HPD? I definitely don’t want to go over anyone’s head, but it does feel like they forgot about me and I want to be responsible on my end. Sometimes I wonder if these marketing agencies take walk-ins. Lol! Like, could I physically go in and ask about my appeal?
I mean at this point you have to take initiative because it seems the marketing agent isn’t following the rules. I also was rejected due to a miscalculation by the marketing agent. And I appealed. And emailed the agent numerous times to tell them they made an error. I also sent them a screenshot of the part of the marketing handbook that shows how to calculate income correctly. And it was overturned and now I’m in my new apartment!
Call HPD 212-863-6300. Eventually when you speak to a person explain your situation and the marketing agency you are working with.

As I understand it, the original Marketing Agent does not process the Appeal. So if you are communicating with them about it perhaps something is not being done according to the proscribed process.
A call to HPD resulted in this today:
- the first appeal will be send directly to the original marketing agent.
- second appeal will go to HPD to review what went wrong.
In other words, the person who did the mistake is offered to fix their mistake, should they accept that they did a mistake in the first place, which is likely NOT what they want to do first thing in the morning..
