My lease expired 7 years ago, and after that, we've never signed any new contract. I still live there and now I need to move out because of my job. When I told my landlord about this 30+ days in advance, she said I need to follow my old lease agreement, which says 60 days notice even though it expires; otherwise I cannot get my security deposit back.
But I consult with a civil court free attorny, he said not neccessary. If it is month to month basis, then 30 days notice is sufficient, I don't need to give her 60 days notice even the old lease says that.
However, some post I found online says I still need to follow the old expired lease... so which one is correct?
