That was sort of my thinking but then I would have to bring it up eventually if that were to continue ... 4% every year so why not now? I also didn't like that I will not know how much my rent will be each year and I should know that since it is rent stabilized.
Also, though there weren't raises every year, sometimes skipping a few years, when there were raises, they were large raises (10-20%).
Anyway, I did bring it up and it looks like it will be resolved easily/amicably etc and will follow the rent stabilization policy.
Lease renewals are sent a few months before the current lease expires so he probably gave you the rate that was available at the time. I don't think he'd wait till Oct 1st to get the new % rate and then FedEx your lease renewal form to you later that afternoon on Oct 1st.

No, I spoke with him and he agrees 4% is wrong. The lease was done in person a few weeks before its effective date (October 1st) and was also dated October 1st 2014 so it's clearly wrong since the new increase of 1% is effective on that date (see link).
Also, the new rate that is effective starting in October I believe is known a few months earlier than October in any case so even if it was sent a few months earlier by fed ex it should still have the correct amount effective October 1st.
It's actually a 3% over increase (4%-1% = 3%) and it comes to low/mid 3 figures over 9 months.
I'm not really interested in focusing on pointing blame however, and I'm not angry with him (for the higher rate) or even myself (for not being up on rent stab rules), I just consider it a learning experience and I just want it fixed (refunded excess) and correct ongoing this way I can be confident of what I am supposed to be paying and I believe after my talk this is what is going to happen within a few days.
I'm glad he clarified it with you and hopefully he'll give you a credit or discount on next month's rent th at equals to all the extra money you've been paying.
Just an update. Lease was corrected with correct lower rent and overpayment refunded amicably. No deposit required. And now no rent increase in October so all is very good. Thanks everyone.
