Of course, pick up the letter if the post office will give it to you. You may need a death certificate and "Letters Testamentary" granted to you by a court to get the mail, maybe only proof of address, not sure how Post Office works this. But that letter is the only way you will get a clue what LL is up to. Perhaps it is a formal offer to buy you/tenant out?

It is based on our relationship as family member, proof I have been living there for more than 2 years, and proof that family member passed away. Everything listed on the website that would qualify me with succession rights

Highly doubt its a buy out. Letter is sent to the deceased family member's name.

Who is paying the rent, if anyone?

Is the landlord accepting your checks?

(Please don't say you pay cash without a receipt.)

So, a judge will make this call when you inevitably end up in court. Make sure you bring the back rent to court with you to pay immediately as the judge will probably order. Make sure in court that you have ALL your proofs of entitlement to apartment succession.
Get in touch with Met Hosing. They may suggest legal help.


Can I assume that you have spelled out to the landlord IN WRITING, preferably by Registered mail with a copy to yourself, your reasons for succeeding your relative/partner? That will preclude any "ignorance defense" when you demand a return of all your legal costs and any ancillary damages.

Some, if not all, landlords should have been smothered at birth.
