Hi,

I just bought a coop 2 months ago and today there was a leak at the unit below my apartment. The coop is saying the leak is due to my tiled bathroom leaking when I shower. So I have a few questions:

I have insurance so I assume they will cover my neighbors damages, but will they cover the cost of me opening my bathroom floor tiles, repair the leak, and install new tiles?

Also, if I want to fight this leak, claiming its a pipe leak and is therefore the co-ops responsibility, should I do that through my insurance? Let them investigate and fight it among themselves through the insurance carriers?

First time coop owner so not too familiar with this process. Thank you.

I guess no one knows. Who's your insurance? Because someone recently told me their insurance company considered a call the same as a claim, so make sure you have a company you can talk to without penalty.

How they've decided it's your tiles and not their pipe is a question you might want to ask them before you take responsibility for anything.

The way insurance works is that the building demands you have it and when there is a claim, the insurance company denies it.

I think the most important thing to find out is the source of the leak. If it's in the pipes, then it isn't your responsibility. If it's your tiles, then it is yours.

yep, if the tiles are original you may be off the hook . if you put them in ,then yep it is your liability .

my sons sink pipe rotted trough under the sink and flooded two floors . they tried to sue him but because the pipes were not touched by him it was not his liability.everyone had to collect from their own insurer

If they are original and still in good condition. But if they have cracks and holes or lack of cauking, then it is the op's responsibility to fix that.

could be , it isn't as black and white as the untouched pipe that rots inside out .
