There doesn't seem to be relevant info on this upon doing a general searches on the nyc forum spectrum.

Condo management company has notorious history of violating its powers to impose ever increasing charges on HOA dues. Management company is actually owned or partially owned by former owner of building who converted it to condominiums. Recent special assessment attempts in the past have included garage repairs when a few, if not none of the owners even own a garage space; the owner rents the spaces out to outsiders. Now, special assessment imposed on elevator that's been in violations for a long time.

The problem it seems to me and most owners of course is mismanagement of HOA dues. They don't supplement the reserve enough for repairs needed down the road and the building itself is not very well maintained even to simple painting of common areas, etc. There's constant leaks on the owners units nearest the elements.

Do they even have the right to impose garage repairs on owners who don't even use the garage? Do they have rights to impose elevator repairs to those who don't even use the elevator; ground floor owners?

Now owners did win a very short-lived war in that we were able to get an independent management company, but have since reverted back to the old management company due to their non transparent powers; they somehow have legal and majority powers that basically submit owners to their mercy. Due to this, I've become frustrated and have refused to pay hoa fees. Now it seems management put a lien on my property without notification.

How much am I in jeopardy of loosing my unit if I maintain my small protest? Do they even have the power to do this (seems they do on a general google search). Don't they need to serve certified mail notification. Should I just pay the accumulated hoa dues and request late penalty, etc removal, if any, and just keep being one of their eternal yes man and piggy bank..?

Has anyone experienced this before? Should I get a real estate lawyer?

I've actually emailed a few owners and they haven't responded. I don't trust the board as they are pro management

Get on a Real Estate App...............Go to your Filter. Scroll down to Max HOA dues? Choose NO HOA DUES. End of problem.
