Good evening All,

Ive been on unemployment for a year. My first determination Letter stated i would get 504, but my first payment was 355. I didn’t think anything of it because the letter said it was an estimated amount but wasn’t guaranteed . I wasn’t aware that I could apply for additional weekly benefits until now . I started receiving benefits 9/30/19 and benefit year ended 10/04/20 . They only have 22 thousand on file for me and I actually made 34 thousand in 2019. I know for a fact that I qualify but unfortunately I wasn’t aware if this form and the 10 day policy that NYS had for this particular form. I was told by unemployment that I submitted the wrong form , and that I will get the increase and retro pay once I submit the proper one . However now they’re telling me that they can’t promise anything because it’s been a year and the department who handles this type of matter will need to make the determination . It’s weird that all the claims specialist told me good news this whole time , And then today they told me I may not get it because I didn’t submit it within ten days . I wasn’t aware of this until now and I’ve never been on unemployment before . They also never sent me a handbook and told me that it’s basically my fault because I didn’t request one . I was also told they if they do approve me they will probably only change the rate moving forward but I won’t get retro pay. I wish I would’ve known my rights from the beginning and as I was stressed and upset for losing myself job my mindset wasn’t really in the best state of mind . Do you think they will give it to me despite the 10 day policy because that’s technically money they took from me and it’s not fair , I know nothing in life is perfect but is there a way around this ? I feel like they ripped me off of my rights . Please advise .....
