Don't get mad. Get even. This is NYC. The only way to get things done is light a fire under people's asses. Stop trying to be nice. If the situation was reversed do you think that your neighbor would show you the same consideration?
Additionally, this is the pre-existing legal duty of the construction site. All you are doing is reminding them of the situation. You have already tried to contact the neighbor and they refused to comply. During the call with 311, the city will ask you to supply your name and information. Do so. They need this in order to proceed with the case. Let the neighbors know - you are putting them on actual notice legally speaking. That means you can use said confirmation receipts from 311 as legal proof if you go to court. At this stage, you are not paying anything - all you are doing is letting them know you are willing to play hardball and to respect you. Are you afraid that they will sue you back? Go ahead. Let them try. Reporting an unsafe construction site is not grounds to be sued. It will be dismissed by a judge and just bring even more bad publicity to the bad actors. If this doesn't work out still then your next step should be to contact the media and let them do a name and shame segment on the nightly news.
