in a pro tenant city like nyc a landlord needs to be 100% within his right to evict or the court won’t allow it

Well why would the landlord try to evict when they are not 100% within their right to do so

because not all landlords are ethical and play by the rules

Only courts in NYS can evict someone.

LLs can only refuse to continue tenancy, which in a month-to-month lease is quite easy.

LLs can (and some often do) have just as much bother getting rid of a month-to-month tenant as a regulated one. If tenant in question will not vacate after being given proper due notice LL's only recourse is housing court.
